5. Course Access & Lifetime Validity

Courses come with lifetime access, subject to the following conditions:

• Access remains valid only as long as the platform and product exist
• Lifetime access may be revoked in case of:
  • Account sharing or misconduct
  • Payment failure or disputes
  • Legal or regulatory requirements

We reserve the right to update or modify course content, pricing, or structure without prior notice.

6. Downloadable Content Policy

Course videos and learning material are only downloadable within the mobile app (HACKXCEL Academy) and are encrypted for offline access. Users are not permitted to:

• Download content externally
• Record or screen capture content
• Distribute, upload, or reshare any material outside the platform

Violation may lead to legal action and access termination.

7. Free vs Paid User Access

Free Users (Webinars, Bootcamps, Community):

• Limited-time access
• No guaranteed support or certificate

Paid Users (Courses, Mentorships, Certifications):

• Full content access with conditional lifetime validity
• Support, community access, and industry-recognized certificates

Terms apply based on user category.

8. User Conduct & Restrictions

You agree to use the platform ethically. The following actions are strictly prohibited:

• Account sharing or misuse
• Attempting to reverse-engineer, hack, or tamper with platform security
• Uploading viruses or harmful code
• Disrupting platform operations
• Using content for commercial purposes without written permission

Violation may lead to temporary or permanent access revocation and legal consequences.

9. Intellectual Property

All course content, videos, documents, logos, and branding are the exclusive intellectual property of HACKXCEL Training & Consultancy or its partners. No user may copy, modify, resell, or create derivative works based on our materials.

10. Industry-Recognized Certificates

Upon successful completion, users may receive industry-recognized digital certificates, sometimes issued in partnership with:

• Government bodies
• ISO-certified organizations
• Reputed private institutions or companies

These certificates are valuable for employment and upskilling but do not substitute for formal university/college degrees unless otherwise stated.

11. Disclaimer of Guarantees

We provide a 7-day pre-placement training program to prepare learners for employment opportunities. However:

• We do not guarantee job placement
• We are not liable for third-party tools, employer decisions, or external opportunities

Use of tools or templates on our platform is at your own discretion.

12. Maintenance, Downtime & Service Interruptions

We strive to offer uninterrupted access. However, we may schedule or face unscheduled maintenance, server upgrades, or downtime. We are not liable for any inconvenience or loss caused due to these temporary interruptions.

13. Termination & Suspension

We may suspend or terminate user accounts for:

• Breach of these Terms
• Fraudulent activity or payment failure
• Violation of usage policies
• Abuse of refund or free content systems

No refunds will be issued post termination due to breach.

14. Modifications to Terms

We reserve the right to update or modify these Terms at any time without prior notice. Continued use after any change signifies your agreement to the revised Terms. The latest version will always be accessible on our website.

15. Limitation of Liability

To the maximum extent permitted by law, HACKXCEL Training & Consultancy shall not be liable for:

• Any indirect, incidental, or consequential damages
• Loss of data or business opportunities
• Inaccuracies in third-party content or tools

16. Indemnification

You agree to indemnify and hold harmless HACKXCEL Training & Consultancy, its partners, and affiliates from any claims, liabilities, damages, legal fees, or losses arising out of:

• Your use of the platform
• Your violation of these Terms
• Any third-party claims arising from your actions

17. Security & Monitoring Rights

We reserve the right to monitor, track, and log user activity on our platform to ensure compliance with these Terms, improve performance, and detect abuse. We may use session tracking and device fingerprinting solely for internal safety and analytics.

18. Fraudulent Activity & Misuse

Accounts found involved in fraudulent transactions, payment disputes without valid cause, or misuse of free trials/offers may be suspended without notice. We reserve the right to take legal action in cases of repeated abuse or misrepresentation.

19. Force Majeure

We are not liable for any failure or delay in performance due to events outside our reasonable control, including but not limited to acts of God, internet outages, platform downtimes, natural disasters, strikes, or legal restrictions.

20. Advertising & Affiliate Guidelines

Users shall not use our platform or its community spaces to promote any third-party businesses, services, links, or affiliate products without prior written consent. Violation may result in access restriction.

21. Dispute Resolution

In case of any dispute:

• We encourage users to first attempt an amicable resolution by contacting our support or grievance officer
• If unresolved, disputes will be subject to the jurisdiction of courts in Jammu & Kashmir, India

22. Governing Law

These Terms are governed by the laws of the Republic of India and any legal proceeding will be under the jurisdiction of the competent courts in Jammu & Kashmir.
